Attorney Erin Thurston was among a team of attorneys that drafted the brief of amicus curiae on behalf of the Massachusetts Academy of Trial Attorneys. The ruling by the Court stated that on a case of first impression in Massachusetts, the SJC clarified the requirements dram shop plaintiff must satisfy to bring a cognizable claim under the statute M.G.L. c. 231 § 60J. An injured or deceased plaintiff's representative can assert facts discovered through investigation and by way of witnesses in the affidavit requirement.
