Jones Kelleher is proud to report on a recent Supreme Judicial Court ruling regarding M.G.L. c. 231 § 60J, often referred to as “the dramshop act."

Attorney Erin Thurston was among a team of attorneys that drafted the brief of amicus curiae on behalf of the Massachusetts Academy of Trial Attorneys. The ruling by the Court stated that on a case of first impression in Massachusetts, the SJC clarified the requirements dram shop plaintiff must satisfy to bring a cognizable claim under the statute M.G.L. c. 231 § 60J. An injured or deceased plaintiff's representative can assert facts discovered through investigation and by way of witnesses in the affidavit requirement. Affidavits submitted through plaintiff's attorney need not be based on personal knowledge. Download a copy of the amicus curiae here.
